Terms of Service

1. Introduction
These Terms govern your use of brolysconsignments.com and the Broly's consignment platform, operated by Jesse Jernigan d/b/a Broly's Consignment Services, a South Carolina sole proprietorship. By creating an account or submitting items, you agree to these Terms.
2. The Service
Broly's is a consignment service. We list eligible trading cards, graded slabs, and authenticated collectibles for sale on Fanatics Collect on your behalf, and we handle submission, grading routing, listing, sale tracking, and payout. We are an independent business and not an agent of, or affiliated with, Fanatics Collect; we make no representations about Fanatics Collect's services, fees, or processes. We do not buy items outright and do not broker private sales.
3. Accounts
You must provide accurate information, keep your login secure, and be responsible for activity under your account. You must be 18 or older.
4. Submitting Items
Each item is subject to our intake review and acceptance; we may decline any item. Items have a $250 minimum value. The specific terms for each item — consignment, and any cleaning services — are governed by the agreements you sign at submission. Those signed agreements control over these general Terms where they conflict.
5. Fees
Our consignment commission is based on each item's hammer price: 10% on items hammering at $999 or under, 8% from $1,000 to $2,999, and 6% at $3,000 and above. Optional services (cleaning) and fronted grading costs are disclosed and deducted from your sale proceeds as described in the agreements you sign. You receive your proceeds by wire after Fanatics Collect remits cleared funds.
6. No Guarantees
Sale prices are set by the market. We do not guarantee that any item will sell, the price it will sell for, the timing of a sale, or the grade a grading company will assign.
7. Limitation of Liability
To the maximum extent permitted by law, Broly's is not liable for indirect, incidental, or consequential damages. Our total liability for any claim relating to an item is limited to the commission we earned on that item. Risk and liability while items are with Fanatics Collect or its grading partners are governed by their policies. Nothing here limits liability that cannot be limited by law.
8. Your Responsibilities
You warrant that you own the items and have the right to sell them, and that they are authentic and unaltered to the best of your knowledge. You agree to indemnify us for claims arising from a breach of these warranties.
9. Changes & Termination
We may update these Terms; continued use means you accept the changes. We may suspend or close accounts that violate these Terms.
10. Governing Law
These Terms are governed by the laws of the State of South Carolina, with disputes resolved in the courts of Horry County, South Carolina.
